Terms of use

Welcome to Forge Tech Accounting. By accessing our website (forge-tech.ca) or using our software, you accept these terms. Please read them carefully.

1. Definitions

  • Forge Tech: Forge Tech Accounting, a company based in Quebec, Canada
  • Service: the Forge Tech Accounting software and all related services (hosting, training, support, etc.)
  • Customer: any person or business that subscribes to the Service
  • Customer Data: all accounting, financial, and operational data uploaded to the Service by the Customer

2. Acceptance and changes

By creating an account or using the Service, you accept these terms. If you represent a company, you confirm having legal authority to bind it.

We may modify these terms. Material changes will be communicated to you by email at least 30 days before they take effect. Continued use of the Service after this period constitutes acceptance.

3. Customer account

  • You are responsible for the confidentiality of your credentials
  • You are responsible for all activity under your account
  • You must notify us immediately of any unauthorized use at [email protected]
  • Forge Tech may suspend an account for fraudulent activity, abuse, or non-payment

4. Plans and billing

4.1 14-day free trial

All new accounts include a 14-day free trial, no credit card required. No amount is charged during this period. Upon expiration, you must activate a paid plan to continue using the Service.

4.2 Paid plans

  • Starter: $49 CAD / month or $490 CAD / year (2 months free)
  • Pro: $99 CAD / month or $990 CAD / year
  • Enterprise: $199 CAD / month or $1,990 CAD / year

All prices are excluding tax. Applicable taxes (GST, QST, HST, or US state sales tax) are added at checkout based on your location.

4.3 Payment terms

  • Payment by credit card (Visa, MasterCard, American Express) processed by Helcim Inc.
  • Bank transfer (EFT) available for Enterprise annual customers
  • Payment is charged on activation date then each renewal cycle
  • On failed payment, we retry up to 3 times before account suspension

4.4 Plan changes

You can change plans anytime from your customer portal. Upgrades are immediate with prorated billing. Downgrades take effect at the next cycle.

4.5 Cancellation and refunds

  • You can cancel anytime from your customer portal
  • Cancellation takes effect at the end of the current billing period — no prorated refund
  • 30-day guarantee: if unsatisfied within the first 30 days of paid subscription, contact us for a full refund of the first payment

5. Service availability

We strive to provide 99.5% Service uptime. Enterprise plans include a custom SLA. Planned maintenance windows are announced at least 48 h in advance.

We are not liable for downtime caused by: (a) your Internet connection, (b) third-party outages (hosting provider, payment provider), (c) force majeure events.

6. Intellectual property

6.1 Our property

The Forge Tech Accounting software, its source code, design, texts, and all associated elements are the exclusive property of Forge Tech. You receive a personal, non-transferable right to use it for the duration of your subscription.

6.2 Your data

Your accounting data belongs to you. Forge Tech acquires no ownership rights over your data. We process it solely to provide the Service.

At any time, you can export your data via the built-in tools (CSV, Excel, PDF). Upon termination, we give you 90 days to perform a full export before permanent deletion.

7. Prohibited uses

You agree not to use the Service for:

  • Any illegal or fraudulent activity
  • Money laundering or tax evasion
  • Attempting to access other users' accounts
  • Reverse-engineering the software
  • Reselling Service access without our written consent
  • Stressing or attacking our infrastructure (DDoS, intensive scraping, etc.)

Any violation may result in immediate account suspension without refund.

8. Limitation of liability

To the extent permitted by law:

  • The Service is provided "as is" without express or implied warranty
  • Forge Tech is not liable for business decisions you make based on data displayed in the Service
  • Our total liability is limited to the amount you paid Forge Tech in the past 12 months
  • We are not liable for indirect, consequential damages, lost profits, or data loss

Important: nothing in these terms limits your Quebec consumer rights (Quebec Consumer Protection Act).

9. Data privacy

Processing of your personal information is governed by our Privacy policy, compliant with Quebec's Law 25 and federal PIPEDA.

10. Termination

10.1 By you

You may terminate anytime from your portal. Effective at the end of the current billing period.

10.2 By Forge Tech

We may terminate your account if you:

  • Materially breach these terms
  • Fail to pay after 60 days despite reminders
  • Use the Service for illegal purposes

We will provide 14 days' notice except in case of serious violation.

11. Governing law and jurisdiction

These terms are governed by the laws of the Province of Quebec, Canada. Any dispute is subject to the exclusive jurisdiction of the courts of the judicial district of Quebec, subject to consumer rights provided by law.
